SMS Program Terms

1. Overview

Cakepop (operated by WhoTheFolk, LLC — “Cakepop,” “we,” “us”) publishes a toll-free “Call or Text” customer support line, (888) 388-CAKE ((888) 388-2253). This is a two-way, transactional, customer-support text program that you start. We do not send marketing or promotional SMS from this line. Order confirmations, tickets, and newsletters are sent by email. Optional marketing texts are a separate, opt-in-only program on its own dedicated number — see section 11.

Scope note: sections 1–10 cover the support text line only. Account texts, like verification codes, are a separate, one-way program sent from a different number and are not described here.

2. How we obtain your consent (you contact us first)

This program is contact-initiated — you reach out to us first. Our toll-free number is published openly, with a live consent disclosure shown next to it in our website footer and in the “Call or Text” menu. You opt in by starting the conversation yourself:

1. You text (888) 388-2253, or
2. You call (888) 388-2253 and ask us to follow up by text.

Starting that conversation is your consent to receive customer-support text messages from Cakepop in reply, about your inquiry. Our first reply identifies us as the sender and tells you how to opt out:

Cakepop Support: thanks for texting us! A team member will reply shortly. Msg & data rates may apply. Reply HELP for help, STOP to opt out.

Consent applies to that support conversation only. We do not add you to any marketing list and do not send you anything else. You can reply STOP at any time (see section 6).

3. The consent disclosure shown wherever the number appears

Everywhere we publish the support number where it can be texted, the following disclosure is shown next to it (in the website footer and in the “Call or Text” menu):

4. Message frequency

Frequency varies and depends entirely on your conversation with us. You receive messages only as part of a support exchange that you started. We do not send recurring, scheduled, or automated marketing SMS through this program.

5. Message and data rates

Message and data rates may apply, per the terms of your wireless carrier plan. Cakepop does not charge you a fee to send or receive SMS in connection with this program.

6. How to opt out or get help

You can opt out at any time by replying with any of the following keywords to a message you received from Cakepop: STOP, STOPALL, UNSUBSCRIBE, CANCEL, END, or QUIT. We will send a one-time confirmation that your opt-out has been processed, and you will not receive any further SMS from this line.

For help, reply HELP or INFO to any message you received from us. You can also text or call (888) 388-CAKE ((888) 388-2253) or email support@cakepop.io for support.

7. Data sharing

Mobile opt-in data — including your phone number, opt-in status, and opt-out preferences — is not shared with third parties or affiliates for marketing or any other purpose. This data is used solely to provide the customer-support replies you request, to honor STOP and HELP keyword responses, and to maintain the integrity of the support line. This program operates on a registered toll-free number, (888) 388-2253. Inbound SMS keywords (HELP / STOP, and their common variants) are supported and acknowledged on the messages we send.

11. Cakepop Event Texts (marketing program)

Cakepop Event Texts is an optional marketing program, separate from the customer-support line above and from account texts like verification codes. If you opt in, you’ll receive event announcements and updates from organizers on Cakepop — new events, added shows, presales, and updates about events you have tickets for, such as a venue or schedule change. The same number also carries the one-time ticket alerts (11.3) and artist alerts (11.4) you can ask for separately. Every message comes from a dedicated toll-free number used only for this program, (866) 631-4532.

11.1 How you opt in

Only you can opt in, in one of these places. Consent is never a condition of purchase, the checkbox is never pre-checked, and we never opt you in automatically or from imported or purchased lists.

1. At checkout, by checking an optional box next to this disclosure:

   Text me about events I might like from organizers on Cakepop. By checking this box, I agree to receive automated marketing texts from Cakepop at the number provided. Consent is not a condition of purchase. Msg frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help.

   If you’re signed in, the box names the verified mobile number on your account and states the same terms.
2. In your notification settings, by turning on Event texts. That disclosure names the verified mobile number on your account and states the same terms: automated marketing texts from Cakepop, consent not a condition of purchase, message frequency, message and data rates, and STOP and HELP.
3. On an event’s “Notify me” form, by checking an optional box, separate from the one-time alert itself (11.3), next to this disclosure (the organizer’s name filled in):

   Text me about future events from [Organizer] and other organizers on Cakepop. By checking this box, I agree to receive automated marketing texts from Cakepop at this number. Consent is not a condition of purchase. Msg frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help.

   It also lets that organizer reach you with the Event Texts they send through Cakepop.

We keep a record of each opt-in: the exact disclosure you were shown, the phone number it covers, when you agreed, and the IP address and device information of the request. Event Texts go only to the number that record covers, and only once we know it’s yours:

• If it’s the verified mobile number on your Cakepop account, texts start right away. If you change your number, they pause until you confirm them for the new one.
• If you opted in with a number that isn’t verified on an account (for example, as a guest at checkout), we send that number one confirmation text, and nothing else until you reply YES:

When your Event Texts start — you turn them on in your settings, or reply YES — we text you this confirmation:

11.2 What the messages look like

Each message names the organizer it comes from, links to the event on Cakepop, and ends with “Reply STOP to opt out of Cakepop Event Texts”. For example:

11.3 One-time ticket alerts

On an event page you can also ask for a single text when tickets go on sale or if more tickets become available. That request is its own one-time consent: you get one automated text from the same number, nothing else, and you aren’t added to Event Texts or any other texting list unless you also check the separate box described in 11.1. If you’re signed in, the alert goes to the verified mobile number on your account (or by email if that number is no longer available). Reply STOP to that text and we won’t text you again from this number.

11.4 Artist alerts

If you follow an artist on Cakepop, you can turn on text alerts for that artist in their follow settings, next to this disclosure (the artist and your verified number filled in):

Text me at [your number] when [Artist] announces a show on Cakepop. By turning this on, I agree to receive automated texts from Cakepop Event Texts about [Artist]’s shows at that number. Consent is not a condition of purchase. Msg frequency varies; msg & data rates may apply. Reply STOP to opt out, HELP for help.

You’ll get one text when that artist announces a show on Cakepop, from the same number. Artist alerts are a separate consent: turning them on doesn’t subscribe you to Event Texts, and Event Texts don’t turn on artist alerts. For example:

11.5 Frequency, timing, and cost

Message frequency varies with what organizers and artists announce. Organizer campaigns, ticket alerts, and artist alerts are delivered between 10 a.m. and 8 p.m. in your local time; updates about an event you hold tickets for, such as a venue change, are sent when the organizer sends them, and a confirmation text you just asked for (11.1) is sent right away. Msg & data rates may apply, per your carrier plan. Cakepop does not charge a fee for this program.

11.6 Opting out

Reply STOP to any Event Texts message. Your wireless carrier confirms and blocks further texts from this number. We also honor STOPALL, UNSUBSCRIBE, CANCEL, END, QUIT, REVOKE, OPT OUT, OPTOUT, REMOVE, and ARRET; for these we send one confirmation and nothing further from this program:

Cakepop Event Texts: You're unsubscribed and won't get more texts from this program. Reply START to resubscribe.

You can also turn off Event texts in your notification settings, and artist alerts in your artist settings. Replying STOP stops every text from this number — Event Texts, ticket alerts, and artist alerts. Opting out does not affect account texts like verification codes, or the support line.

11.7 Opting back in

Text START or UNSTOP to the Event Texts number, (866) 631-4532. You’ll receive:

11.8 Help

Reply HELP or INFO to any Event Texts message and you’ll receive:

11.9 Carriers

Wireless carriers (e.g., AT&T, T-Mobile, Verizon) are not liable for delayed or undelivered messages.

11.10 Privacy

No mobile information will be shared with third parties or affiliates for marketing or promotional purposes. Text messaging originator opt-in data and consent will not be shared with any third parties, and we never sell them. Organizers of events you’ve bought tickets for, or asked to hear from, can see whether you’ll receive the Event Texts they send through Cakepop, but never your consent records, and your Event Texts consent covers only messages sent by Cakepop through this program.
